Sweepstakes is open to legal residents within the Orlando Magic Team territory in the state of Florida, who physically reside in this eligibility area only and who are 21 years of age or older as of 01/25/10. Sweepstakes begins at 12:01 a.m. EST on January 25, 2010 and ends at 11:59 p.m. EST on March 1, 2010 (“Sweepstakes Entry Period”). This Sweepstakes is sponsored by AirTran® Airways and the Orlando Magic, Ltd. (“The Sponsors”). Void where prohibited or restricted by law.1. ELIGIBILITY: The Sweepstakes is open to individual legal residents within the Orlando Magic Team territory in the state of Florida, 21 years of age or older as of the beginning of the sweepstakes, except for employees and their immediate families (including children, spouses and siblings and/or personal living in the same households as such persons, whether related or not) and members of the same household of the Sponsors, Orlando Magic, Ltd., Cramer-Krasselt, Fulfillment Systems, Inc., Amway Arena, RDV Sports, Inc., the National Basketball Association (“NBA”) and its Member Teams, NBA Properties, Inc. and each of their respective parent organizations, subsidiaries, affiliates, directors, officers, owners, advertising and promotion agencies, and agents. This Sweepstakes is subject to all applicable federal, state and local laws. By participating, entrants agree to be bound by these Official Rules and the decisions of the Judges and/or Sponsors, which are binding and final on matters relating to this Sweepstakes.
2. HOW TO ENTER: Go to www.airtran.com/magic during the “Sweepstakes Entry Period” and register for the AirTran® Airways A+ Rewards program, if you are not already a member. If you are already an AirTran A+ rewards member, you can also opt in to enter for the Sweepstakes as directed online. AirTran Airways A+ Rewards Registration is free; You may also enter alternately by mailing a postcard with your name, complete address, daytime phone number and birth date to: AirTran Airways Orlando Magic Sweepstakes, C/O AirTran Airways, 5230 Clipper Drive, Suite 100, Atlanta, GA 30349. Mail in entries must have sufficient postage and must be postmarked by March 1, 2010 to be eligible. Limit of one entry per person, regardless of method of entry.
3. PRIZE/APPROXIMATE RETAIL VALUE “ARV”: On or about March 4, 2010, a random drawing will be conducted by an Independent Agent of the Sponsor, from amongst all eligible entries received during the Sweepstakes Entry Period for the following prize: One (1) Grand Prize – Tickets for winner and up to (11) eleven guests to the “Orlando Magic” Game, on March, 17, 2010. Winner and guests will watch the game from the AirTran Airways “flight deck” suite at the Amway Center in Orlando, FL. Winner and guests must be available to attend event on date specified by the sponsor in their sole discretion. Prize does not include transportation to and from the winner and guests’ residence to the event in Orlando. Approximate retail value of Prize is: $3,000. All federal, state and local taxes and other expenses including ground transportation, parking, meals, incidental expenses and gratuities, are the winner’s sole responsibility. Winner may be required to sign an IRS form 1099 or the equivalent. By participating in this sweepstakes, each entrant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of the judges, and warrants that he or she is eligible to participate in the sweepstakes. Prize is not transferable. Winner will be notified by email, mail or phone and must return all required documents within the indicated time period. Potential Grand Prize Winner will be contacted on or about March 4, 2010 and required to execute an Affidavit Publicity/Liability Release, to be returned within five (5) days of date notice was sent. All guests of winner must be 21 years of age at the time of the event and will be required to complete and return a liability of release to the sponsor, prior to event. In the event of noncompliance with the foregoing requirements or if prize notification is returned as undeliverable, two attempts to contact winner by phone are unsuccessful, or winner declines the prize, prize will be forfeited and, at Sponsor’s discretion, an alternate winner will be selected. The Sponsor does not assume any responsibility or liability if any portion of the event is cancelled, delayed, suspended or rescheduled. If event is rescheduled, Sponsor’s liability is limited to award of Grand Prize as stated above, with winner attending an alternate event, determined by sponsor in their sole discretion. Sponsor’s liability is limited to award of an alternate, substitute prize of Sponsor’s sole choosing of equal or greater value. The Sponsor further disclaims any and all representations and warranties, expressed or implied, in fact or in law, in connection with prize. Prize will be awarded (assuming sufficient number of eligible entries). No more than the advertised number of prizes will be awarded.
4. TERMS OF SUBMISSION: By entering, you agree that you are 21 years of age or older as of January 25, 2010. Additionally, by entering, you acknowledge that you have read and understood these Official Rules, which incorporates the www.aplusrewards.com Privacy Policies and Terms of Service (as appropriate), and you accept these Official Rules together with all of the policies referenced herein and agree to abide by its terms and conditions, as they may be amended from time to time, and all applicable rules and regulations.
5. GENERAL RULES: Orlando Magic, Ltd., Cramer-Krasselt, Fulfillment Systems, Inc., Amway Arena, RDV Sports, Inc., the National Basketball Association (“NBA”) and its Member Teams, NBA Properties, Inc. and each of their respective parent organizations, subsidiaries, affiliates, directors, officers, owners, advertising and promotion agencies, and agents, (collectively, “Released Parties”) are not responsible for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines or technical failures or difficulties, or other errors of any kind whether human, mechanical, electronic, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes or in any Sweepstakes-related materials; or the incorrect or inaccurate capture of entry or other such information or the failure to capture any such information. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Sponsor is not responsible for lost, late, damaged, postage due or misdirected mail/entries. Released parties are not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in the Sweepstakes or downloading materials from or use of the web site. Persons who tamper with or abuse any aspect of the Sweepstakes or website, as solely determined by Sponsor, will be disqualified. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES, IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW (AND TO DISQUALIFY SUCH PERSON FROM THE SWEEPSTAKES, IF APPLICABLE).
Should any portion of the Sweepstakes be, in Sponsor’s sole discretion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole discretion of the Sponsor, corrupt or impair the administration security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and conduct the Sweepstakes in a manner which in its sole discretion is fair, appropriate and consistent with these Official Rules. Notice of such action by Sponsor will be posted on www.airtran.com/magic. Entrants, by participating, agree that Released Parties and their respective website providers/web masters, and all of their respective officers, directors, employees, representatives and agents will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of a prize or participation in this Sweepstakes. Winner, by acceptance of prize, except where legally prohibited, grants permission for Sponsors, Orlando Magic, Ltd., Amway Arena, RDV Sports, Inc., the NBA and its Member Teams, NBA Properties, Inc. and each of their respective parent organizations, subsidiaries, affiliates, directors, officers, owners, advertising and promotion agencies, and agents, and their designees to use his/her name, address (city and state), photograph, voice, and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide, and on the Internet and world wide web, in perpetuity, without notice or review or approval.
6. CONDITIONS: By entering a Submission, Winner agrees to hold harmless and indemnify Sponsors, Orlando Magic, Ltd., Cramer-Krasselt, Fulfillment Systems, Inc., Amway Arena, RDV Sports, Inc., the NBA and its Member Teams, NBA Properties, Inc. and each of their respective parent organizations, subsidiaries, affiliates, directors, officers, owners, advertising and promotion agencies, and agents from any and all liability, loss or damages or causes of action arising from or in connection with entrant’s participation in or winner’s receipt or use of the prize awarded in the sweepstakes. Sponsors are responsible only for delivery of prize, not for use, utility, quality or otherwise. This sweepstakes is void where prohibited or restricted by law and is subject to all applicable federal, state and local laws and regulations. The sweepstakes shall in all respects be governed by, and construed in accordance with, the laws of the State of Florida, including all matters of construction, validity and performance, without giving effect to its conflict of laws provisions. If any portion of these Official Rules is found to be invalid, illegal or unenforceable, for any reason, that portion shall be severed from the rest and shall not affect the agreement to resolve all controversies and claims through arbitration. These Official Rules supersede any and all agreements or communications of any kind between you and the Sponsor or anyone associated with the Sweepstakes, and cannot be modified or waived except in writing and unless properly signed.
7. INFORMAL DISPUTE RESOLUTION: (a) Prior to filing any arbitration proceeding pursuant to paragraph 7(b) hereof, the party intending to file such a proceeding shall notify the other party in writing of the existence and the nature of the dispute. The parties each agree that within ten (10) business days of the other party's receipt of such notice, a representative of each party shall meet for a minimum of one (1) eight (8) hour day, or such shorter period of time if the dispute is more quickly resolved, in Orlando, Florida in order to attempt to amicably resolve the dispute. If such informal dispute resolution attempts prove to be unsuccessful, the notifying party may initiate the dispute resolution procedures available as set forth herein. Each party shall bear its own costs associated with the meeting and in no event shall either party be liable to the other for any costs or expenses incurred as a result of such meeting.
(b) Arbitration. Except as provided in paragraph 7(c) with respect to injunctive proceedings, and paragraph 7(a) with respect to informal dispute resolution, all controversies, disputes or claims arising between the parties arising out of or related to the sweepstakes shall be submitted promptly for arbitration to be conducted in Orlando, Florida, and administered by the American Arbitration Association. Such arbitration proceedings shall be resolved by a single arbitrator selected by mutual agreement of the parties. If the parties are unable to agree on the appointment of the arbitrator to resolve the dispute within thirty (30) days from the date when the request for arbitration initially has been communicated to the other party, such appointment shall be made by the American Arbitration Association. The arbitrator shall have the right to award or include in the award any relief deemed proper under the circumstances, including attorneys’ fees and costs incurred by the prevailing party. The award and decision of the arbitrators shall be conclusive and binding upon all parties hereto and judgment upon the award may be entered in any court of competent jurisdiction. The parties waive any right to contest the validity or enforceability of such award.
(c) Injunctive Relief. The parties acknowledge that violation of these Official Rules would cause irreparable harm that would not be adequately compensable by monetary damages. In addition to other relief, it is agreed that preliminary and permanent injunctive relief will be available to prevent any actual or threatened violation of such provisions.
8. WINNERS LIST/RULES REQUESTS: These Official Rules will be made available at www.airtran.com/magic during the Sweepstakes Entry Period. Winner information will be made available on www.airtran.com/magic after March 4, 2010.
